TERMS & CONDITIONS OF ACCESS TO THE WEBSITE

These general contractual conditions govern the terms and general conditions of use of the website of Marvãogest - Gestão de Móveis e Imóveis Lda., headquartered at Rua Vivas, no. 34, 7330-012 Beirã, registered at the Lisbon Commercial Registry Office under the sole registration and corporate number 51009996 (hereinafter referred to as "MARVÃOGEST" and "Website").

I – General Aspects Use of the Website automatically confers the status of User and implies full and unconditional acceptance of all provisions included in these Terms & Conditions, in the version in force at the time of accessing the Website.

If you do not fully accept any of the established conditions, you should not access/use the Website. By browsing or using the Website, you agree to comply with the conditions set out in this document.

Users may use the Website without any registration. However, some functionalities of the Website may require registration.

 

II – Products and Services The information about products and services presented on the Website is intended solely to provide a brief informative summary for the User's convenience.

MARVÃOGEST takes all measures to ensure that the information and data contained on the Website are accurate and up-to-date at the time they are entered. However, MARVÃOGEST does not undertake to update or correct this information. MARVÃOGEST provides no warranties, express or implied, regarding the accuracy or completeness of any information included on the Website.

MARVÃOGEST reserves the right to change, delete or move any information on the Website at any time without prior notice.

Users expressly accept and acknowledge that:

  • The photographs displayed on the Website are for illustrative purposes only;

  • MARVÃOGEST will make all reasonable efforts to include accurate and up-to-date information about products and services on the Website, although it does not guarantee it;

  • MARVÃOGEST does not guarantee the availability of products shown on the Website and is not liable for discontinued products (where applicable).

III – Registered User Profile To access a broader range of features, Users may register their profile on the Website.

To do so, Users must fill out a form in which, in addition to optional elements, they must provide the following mandatory information:

  • Email address;

  • Password.

All information provided by the User must be true. Users must update the information provided to MARVÃOGEST whenever there are any changes. Users are solely responsible for any false or inaccurate statements made and for the damages they may cause to MARVÃOGEST or third parties with the information provided.

MARVÃOGEST is not responsible for any damages resulting from the improper or negligent use of the password defined by the User to access the profile. Users must ensure the confidentiality of their password.

In the profile panel, Users can view their most recent orders, manage shipping and billing addresses, and edit profile details and password.

 

IV – Delivery of Products Purchased on the Website Products purchased on the Website will be delivered to the User by companies specialized for that purpose, completely unrelated to MARVÃOGEST. Delivery may take 24 to 72 hours for mainland Portugal, although MARVÃOGEST does not guarantee this timeframe.

The delivery period only starts after the purchase amount has been paid by the User.

 

V – Shipping Costs The shipping cost for products purchased on the Website will be automatically calculated during the purchase process and varies depending on the quantity or weight of the order, as applicable:

  • up to 5kg: €6.68

  • up to 5kg: €8.20

  • over 5kg: €13.33

  • for orders over €50: free shipping

  • for pickup at our locations in Lisbon or Cadaval, by appointment: free shipping

These prices apply to shipping within mainland Portugal. For shipments to the autonomous regions of Madeira and the Azores or abroad, transport prices will be subject to prior consultation.

 

VI – Returns If the User wishes to return any product purchased on the Website, they must immediately send an email to geral@quintadoolivaldamurta.pt stating the reason for the return. After sending the email, they will be informed on how to proceed. Returns must be made within 14 days of receiving the product and will only be accepted if the products are in proper condition (i.e., in the same condition as received, including original packaging). Shipping costs are entirely borne by the User, and only the full amount of the returned products will be refunded.

Returns due to product defects are excluded. If a defect is found within 2 years of purchase, the defective product will be replaced with an identical or similar one at no extra cost to the User. The User may also opt for a repair (if applicable) or contract cancellation.

 

VII – Personal Data and Data Security MARVÃOGEST is committed to protecting the security of your personal data.

Data processing by MARVÃOGEST complies with the legislation in force regarding personal data, namely Law no. 67/98 of October 26, and, where applicable, is duly notified to the National Data Protection Commission.

Your personal data may be used to provide important information about the services you have subscribed to, including updates and notifications.

Additionally, with your consent, we may send commercial information about MARVÃOGEST products and services and those of its partners. Your personal data will not be shared with third parties responsible for data processing without your permission.

MARVÃOGEST may contract other companies to provide services on its behalf, such as website hosting, email, responding to user inquiries, sending information about new services and products, and special offers. These companies will only be given the personal data necessary to provide the service. They are required to maintain the confidentiality of the information and are prohibited from using it for other purposes, acting as MARVÃOGEST subcontractors.

MARVÃOGEST may disclose personal data if required by law or in good faith believes it is necessary to: (a) comply with the law; (b) protect and defend its rights; (c) act in urgent circumstances to protect the personal safety of its employees, users, partners, or the public.

VIII – Intellectual Property Unless otherwise stated, all materials on the Website, including design, text, graphics, photographs, and presented content, are intellectual property owned, controlled, or licensed by MARVÃOGEST. Modification, reproduction, duplication, copying, distribution, sale, resale, and other forms of exploitation, whether commercial or not, are prohibited.

Nothing in this document should be construed as granting any license or right under any intellectual property owned by MARVÃOGEST or third parties.

 

IX – Limitation of Liability Users are responsible for the content of any information sent or transmitted to the Website.

Users acknowledge that use of the Website may not be 100% secure, and information sent/received may be intercepted by unauthorized parties. MARVÃOGEST is not responsible for communication security failures or for misuse of information by third parties.

Users acknowledge that access to and use of the Website may be interrupted and that Website information may contain bugs, errors, technical issues, problems, or other limitations.

To the fullest extent permitted by law, MARVÃOGEST excludes any liability, direct or indirect, arising from the use of the Website.

 

X – Final Provisions In case of violation of these Terms & Conditions, MARVÃOGEST reserves the right to take any legally foreseen action. Additionally, MARVÃOGEST reserves the right to terminate access or use of the Website at its discretion, with or without notice to the User.

The Terms & Conditions of Website use are governed by Portuguese law.

If any provision described here is found to be illegal, void, or unenforceable for any reason, that provision will be eliminated or reduced in accordance with the law, without affecting the validity and enforceability of the remaining provisions.

MARVÃOGEST reserves the right to change these Terms & Conditions without prior notice. Users are bound by the version of the Terms & Conditions in effect at the time of use and are therefore advised to check them periodically.
